Technical capability notice

A UK legal tool that can require an operator to maintain or support certain access capabilities.

A technical capability notice is a UK legal instrument that can require a communications or technology operator to maintain, build, or support specific technical capabilities for lawful access. In practice, that may mean keeping a system able to provide data, preserve a route to access it, or support a capability that makes future access possible under legal authority.

This matters in cyber security because it sits at the intersection of cryptography, system architecture, and compliance. A notice does not automatically break encryption, but it can pressure a provider to keep recovery paths, metadata handling, or access features in place. For end-to-end encrypted services, the key question is feasibility: if only user devices hold the keys, the provider may have no practical decryption path to maintain. In defense planning, this is why key custody, backup design, and recovery mechanisms are so sensitive. The same architecture that protects users from attackers can also limit what a provider can legally and technically deliver.
