Dissenting opinion

A judge's written disagreement with the majority decision in a case.

A dissenting opinion is a judge’s written disagreement with the reasoning or outcome adopted by the majority in a case. It records an alternative legal interpretation and may explain why the dissenting judge believes the decision should have gone another way.

In legal AI and precedent research, dissenting opinions matter because search and ranking systems can favor frequently cited majority decisions, making less prominent arguments harder to find. Including dissents in analysis can help lawyers and researchers review competing interpretations rather than seeing only the dominant view. A dissent does not itself control the case’s result, but it can inform later legal debate and reveal unresolved questions.
